Crypto Tax Regulations in South Africa: The 2026 SARS Rules
Last Updated: September 2026 | Reading Time: 7 minutes
SARS taxes crypto – full stop. Whether your Bitcoin profit is taxed as income (up to 45%) or capital gains (effective max 18%) depends on your intent and behaviour, and SARS now gets data straight from exchanges.
Quick Answer
In South Africa, crypto assets are taxed as either revenue or capital gains. Frequent trading, staking rewards, mining and airdrops are usually income (up to 45%); long-term holding is usually CGT with a R40,000 annual exclusion (max effective 18%). Declare all crypto on your ITR12 – SARS receives data from local exchanges and failure to declare is a criminal offence.
Income Tax or Capital Gains Tax?
SARS has no special crypto tax – it applies normal tax principles to crypto assets:
- Revenue (income): if you bought crypto to trade it, or earned it through mining, staking, airdrops, referral rewards or being paid in crypto, the profit or value is fully taxable at your marginal rate (18%-45%).
- Capital: if you bought and held crypto as a long-term investment, the gain on disposal is a capital gain. After the R40,000 annual exclusion, 40% of the gain is included in taxable income – a maximum effective rate of 18%.
The official position is on the SARS crypto assets page.

Record-Keeping SARS Expects
- Date and rand value of every acquisition and disposal
- Exchange statements and wallet transaction histories
- Cost base per coin (what you paid, including fees)
- Bank statements showing fiat deposits and withdrawals
Keep these for five years. If SARS queries your return, you must reconstruct your gains – see what happens in a verification.
How to Declare Crypto on the ITR12
The ITR12 asks specifically about crypto assets. Trading income goes under local business/trading income (which usually makes you a provisional taxpayer); capital disposals go in the capital gains container. Losses can offset gains of the same nature – capital losses ring-fence against capital gains.
What Happens If You Do Not Declare
SARS has received third-party data from South African crypto exchanges for years and runs dedicated crypto audit letters. Non-declaration can mean understatement penalties up to 200%, interest, and criminal prosecution. If you have past undeclared crypto gains, the SARS Voluntary Disclosure Programme lets you regularise before SARS comes to you – and our tax disputes team handles VDP applications nationwide.

Frequently Asked Questions
Does SARS really know about my crypto?
Yes. Licensed South African exchanges report client transaction data to SARS, and SARS has issued audit letters to crypto traders since 2021. Declaring voluntarily is far cheaper than being caught.
Is swapping Bitcoin for USDT a taxable event?
Yes. Any disposal – including crypto-to-crypto swaps – triggers a gain or loss calculated in rand at the time of the swap. You cannot defer tax by staying inside the crypto ecosystem.
Can I deduct crypto losses?
Capital losses offset capital gains and carry forward to future years, but cannot reduce your salary income. Trading losses can offset other income in some cases, but SARS may ring-fence them if it suspects a hobby rather than a trade.
